In carrying out its functions, Banca d'Italia processes personal data (i.e. information relating to an identified or identifiable natural person) in compliance with data protection legislation.
The European legislation on personal data protection (Regulation 2016/679; General Data Protection Regulation- GDPR), in force since 25 May 2018, has redefined the rules in this area, harmonizing at EU level the principles and arrangements that safeguard the rights and fundamental freedoms of natural persons. The Italian legislator has issued implementing provisions for the GDPR, adapting the pre-existing Personal Data Protection Code (Legislative Decree 196 of 30 June 2003, as amended by Legislative Decree 101 of 10 August 2018), which now sets out additional rules solely for the areas of exclusive national competence.
The Data Protection Officer
The GDPR envisages the creation in public institutions of the role of Data Protection Officer (DPO), a person who advises on and oversees the application of privacy legislation.
