The Quaderno di ricerca no. 103 includes some of the reports that were presented during the conference organised by the Legal Services Directorate on 29 September 2023 named Il Regolamento MiCA nel contesto della disciplina bancaria e dei servizi di pagamento.
The aim of the seminar was to provide an initial immediate reading of the Regulation (EU) 2023/1114 of the European Parliament and of the Council of 31 May 2023 on markets in crypto-assets, and amending Regulations (EU) No 1093/2010 and (EU) No 1095/2010, and Directives 2013/36/EU and (EU) 2019/1937, the so-called MiCA, which was just published in the Official Journal of the European Union at the time.
The volume presents the reports in the same order as they were discussed during the conference and, in particular, contains those regarding the following topics i) taxonomy of crypto-assets regulated in the MiCA Regulation (ARTs, EMTs and other than), illustrating their identification criteria and definitions; ii) issuers of payment tokens and the special regime applied to 'significant' ones; iii) the Offering on the market of payment tokens, examining the role of the white paper and of preventive controls; iv) the protection of consumers and users of payment tokens, retracing the regulations from the consumer code to the MiCAR; v) e-money tokens, examined in comparison with traditional electronic money; vi) crypto-asset service providers, focusing on their requirements and on the supervisory regime; vii) AML Regulations applicable to the issuance and circulation of payment tokens.
For easy reference, the volume is integrated in the appendix by the text of the MiCA regulation and by that of italian Legislative Decree no. 129/2024.
